These Terms & Conditions of Sale (“Terms”) govern the sale of products offered by Dione through its website themaisondione.com (the “Website”).

By placing an order through the Website, the Customer acknowledges having read and accepted these Terms.

Dione reserves the right to amend these Terms at any time. The Terms applicable to an order are those accepted by the Customer at the time the order is placed.

The Customer may save or print these Terms for future reference.

Article 1 – Seller Information

Dione may also be referred to as “Dione”, “Maison Dione” or the “Seller” throughout these Terms.

The Seller’s full legal identification, including its legal form, registration number and, where applicable, VAT number, is provided in the Website’s Legal Notice.

Article 2 – Scope and Acceptance of the Terms

These Terms apply to all orders placed through the Website by customers acting as consumers or non-professional purchasers (the “Customer”).

Before placing an order, the Customer confirms that they have read and accepted these Terms without reservation.

By confirming an order, the Customer expressly agrees to the Terms applicable on the date of the order.

These Terms remain accessible on the Website at all times.

The Customer agrees not to use the Products or the Website for fraudulent, unlawful or abusive purposes.

Article 3 – Products

Dione offers premium hair products for sale through the Website (the “Products”).

The Website provides information intended to allow the Customer to understand the essential characteristics of each Product before placing an order.

Product photographs, videos and visual content are provided for illustrative purposes. Minor variations may occur depending on lighting, photography, screen settings or the natural characteristics of the Product.

The Customer is responsible for carefully reviewing the Product page before placing an order, including information relating to:

  • Product type;
  • texture;
  • colour;
  • length;
  • weight;
  • available variations;
  • and any specific characteristics of the Product.

Certain Products may be offered on a pre-order basis. Where applicable, the pre-order status and estimated availability or shipping timeframe will be clearly indicated on the relevant Product page and/or during the ordering process.

Article 4 – Orders and Pre-Orders

The Customer may place an order with or without creating an account, where this option is available.

The Customer must provide accurate, complete and up-to-date information, including their name, delivery address, email address and telephone number.

The Customer is responsible for any consequences resulting from inaccurate, incomplete or outdated information provided when placing an order.

Before confirming an order, the Customer may review the Products selected, applicable variations, quantities, delivery address and total price and make any necessary changes.

Once the order has been confirmed, it constitutes a final commitment by the Customer, subject to Dione’s confirmation and to any mandatory rights granted to the Customer under applicable law.

An order confirmation will be sent to the Customer by email.

Pre-Orders

Products offered as pre-orders are purchased and paid for before they are physically available for shipment.

The estimated availability or shipping timeframe displayed at the time of purchase is based on the information available to Dione when the pre-order is placed.

Dione will use reasonable efforts to meet the estimated timeframe and will inform the Customer without undue delay of any significant change affecting the expected availability or delivery of the Product.

Once a pre-order has been confirmed and payment has been completed, the order cannot be modified at the Customer’s request.

This includes, without limitation, requests to change:

  • the Product;
  • texture;
  • colour;
  • length;
  • quantity;
  • or delivery address.

This restriction applies subject to any mandatory statutory rights available to the Customer under applicable law.

Customers are therefore strongly encouraged to carefully review all order details before confirming a pre-order.

The pre-order nature of a Product does not, by itself, remove any statutory right that may apply to the Customer.

Refusal or Cancellation of an Order by Dione

Dione reserves the right to refuse or cancel an order for a legitimate reason, including but not limited to:

  • suspected fraud or attempted fraud;
  • fraudulent use of a payment method;
  • unusually large or suspicious orders;
  • violation of these Terms;
  • exceptional circumstances preventing Dione from fulfilling the order;
  • or an unresolved payment dispute relating to a previous order.

Where Dione cancels an order after payment has been received, amounts actually paid for the cancelled order will be refunded in accordance with applicable law.

Article 5 – Prices and Payment

Prices displayed on the Website are stated in euros and include applicable taxes, unless otherwise indicated.

Shipping fees are displayed separately before the Customer confirms payment.

For international orders, customs duties, import taxes, customs clearance fees and any other charges imposed by the destination country or local service providers are not included in the displayed Product price or shipping fees unless expressly stated otherwise.

Such charges remain the sole responsibility of the Customer.

The Customer is responsible for paying any applicable customs duties, import taxes or clearance fees directly to the relevant authorities, carrier or customs intermediary.

The full purchase price is payable at the time the order is placed, including for Products offered on a pre-order basis.

Available payment methods are displayed during the checkout process and may vary depending on the Customer’s country.

The Customer confirms that they are legally authorised to use the selected payment method.

Payments may be processed through third-party payment providers. Where payment is processed directly by a secure payment provider, Dione does not have access to the Customer’s complete payment card details.

An electronic invoice may be made available or sent to the Customer in accordance with applicable requirements.

Article 6 – Shipping and Delivery

Products are shipped to the delivery address provided by the Customer at checkout.

Dione may use different shipping partners depending on the destination country, order type and applicable logistics conditions.

Shipping partners may include DHL, UPS, Chronopost or any other carrier selected by Dione.

Dione reserves the right to change its logistics and shipping partners.

For pre-orders, the estimated shipping or delivery timeframe communicated to the Customer takes into account the time required for the Product to become available for shipment.

Where applicable law requires a specific delivery deadline or date, the Customer’s statutory rights and remedies shall apply. French consumer law requires the professional to provide information regarding the date or timeframe within which the goods will be delivered.

The Customer is responsible for ensuring that the delivery address provided at checkout is accurate and complete.

If an incorrect or incomplete address results in additional shipping costs, return of the parcel or re-shipment, such costs may be charged to the Customer where permitted by applicable law.

Upon delivery, the Customer is encouraged to inspect the external condition of the parcel and the Product and to promptly report any apparent issue to Customer Service, without prejudice to the Customer’s statutory rights.

Article 7 – Withdrawal, Returns and Refunds

This Article is intentionally detailed because Dione’s Products are hair products and may be significantly altered through use, washing, colouring, cutting, styling or chemical treatment.

7.1 Statutory Right of Withdrawal

Where French consumer law applies, a consumer purchasing Products online generally has a statutory fourteen (14) calendar day withdrawal period.

For sales of goods, this period generally begins on the day the Customer, or a third party designated by the Customer other than the carrier, receives the Product.

The Customer is not required to provide a reason for exercising the statutory right of withdrawal.

The right of withdrawal is separate from Dione’s commercial return policy and remains subject to the statutory conditions and exceptions applicable to the relevant Product.

The fact that a Product was purchased as a pre-order does not, by itself, eliminate a statutory right of withdrawal.

7.2 How to Request a Return

A Customer wishing to exercise their statutory right of withdrawal must notify Dione clearly before the expiry of the applicable withdrawal period.

The Customer should include:

  • full name;
  • order number;
  • Product concerned;
  • date of purchase;
  • and a clear statement that they wish to exercise their right of withdrawal.

Simply returning a Product without communicating the decision to withdraw does not, by itself, constitute a valid notification of withdrawal.

Once the Customer has notified Dione of the withdrawal, the Product must be returned without undue delay and, in principle, no later than fourteen (14) days after the notification of withdrawal.

7.3 Return Shipping Costs

Unless Dione expressly agrees otherwise, the direct cost of returning the Product is borne by the Customer, provided that the Customer was informed of this obligation before placing the order.

For international returns, the Customer is also responsible for any customs charges, duties, taxes or other costs arising from the return shipment where applicable.

Dione will not be responsible for return shipping costs resulting from a Customer’s change of mind where the law places such costs on the Customer.

7.4 Strict Condition of Returned Hair Products

Because Dione sells hair products intended for direct personal use, all returned Products must remain in an unused and unaltered condition, subject to the Customer’s statutory right to handle the Product only to the extent necessary to establish its nature, characteristics and proper functioning.

For hair Products, including bundles and closures, the Product must not have been:

  • worn or installed;
  • washed or soaked;
  • wet;
  • coloured or dyed;
  • bleached or chemically processed;
  • cut or trimmed;
  • thinned;
  • chemically treated;
  • heat-styled;
  • curled or straightened;
  • brushed or manipulated beyond what is reasonably necessary to inspect the Product;
  • altered, customised or modified;
  • damaged;
  • or otherwise used.

The Product must also retain, where applicable, its original tags, security ties, protective elements, packaging and other identification elements supplied with the Product.

Any Product that has been worn, installed, washed, coloured, bleached, cut, chemically treated, heat-styled, modified or otherwise used beyond what is necessary to inspect its nature, characteristics and proper functioning may be subject to a deduction for loss in value or may be excluded from return where a statutory exception to the right of withdrawal applies.

This is important legally: French law allows the consumer to handle a product only to the extent necessary to establish its nature, characteristics and proper functioning; the consumer may be liable for depreciation caused by handling beyond that level, provided the required information regarding the withdrawal right was supplied.

7.5 Product Inspection

Dione reserves the right to inspect every returned Product before processing the refund.

This inspection may include verification of:

  • whether the Product has been worn or installed;
  • whether the Product has been washed or wet;
  • whether the texture has been altered;
  • whether the Product has been coloured, bleached or chemically treated;
  • whether the Product has been cut or modified;
  • whether the Product has been heat-styled;
  • whether the Product has been damaged;
  • whether the original identification elements remain attached;
  • and whether the Product corresponds to the Product originally shipped.

Where the condition of the returned Product indicates handling beyond what is necessary to inspect its nature, characteristics and proper functioning, Dione may apply the consequences permitted by applicable law, including a deduction corresponding to the loss in value caused by such handling.

Dione will not treat a statutory right of withdrawal as automatically cancelled merely because a Product has been opened. Any exclusion based on hygiene or health protection will only apply where the statutory conditions for such an exception are actually met.

7.6 Hygiene and Sealed Products

Where a Product has been sealed after delivery and the applicable statutory conditions are met for an exception based on hygiene or health protection, the statutory right of withdrawal may not apply once the seal has been removed.

This exception will only be applied where legally applicable to the specific Product concerned.

Dione will not rely on a general statement that all hair Products are automatically non-returnable solely because they are hair Products.

7.7 Personalised Products

Where a Product has been made according to the Customer’s specifications or has been clearly personalised, the statutory right of withdrawal may be excluded where the legal conditions for such exclusion are met.

Any such exclusion will be communicated to the Customer before the order is placed.

7.8 Packaging and Accessories

Customers are required to return the Product with its original packaging and any accessories or identification elements supplied with the Product where these are necessary for the proper protection or identification of the Product.

The absence or damage of packaging or accessories may result in consequences permitted by applicable law where it causes a demonstrable loss in value.

7.9 Proof of Return

The Customer is responsible for obtaining and retaining proof of shipment of the returned Product until Dione confirms receipt.

Dione cannot be held responsible for a return parcel that is lost in transit where the Customer cannot provide evidence that the Product was properly shipped.

7.10 Refunds

Where the statutory right of withdrawal has been validly exercised, Dione will refund the amounts legally due within the applicable statutory timeframe.

For sales of goods, Dione may, where permitted by law, defer the refund until the returned Product has been received or until the Customer provides evidence that the Product has been shipped back, whichever occurs first.

The refund will generally be made using the same payment method used for the original transaction, unless the Customer expressly agrees to another method where permitted by law.

Dione will reimburse the standard delivery costs paid by the Customer where required by applicable law. Additional costs resulting from the Customer’s choice of a more expensive delivery method than the standard delivery option offered by Dione may be excluded from the refund where permitted by law.

The statutory framework provides that the consumer bears the direct return costs unless the seller has agreed to bear them or failed to inform the consumer that they were payable by the consumer.

7.11 Returns That Do Not Comply With the Return Conditions

Where a returned Product shows evidence of use, alteration, washing, colouring, cutting, chemical treatment, heat styling or other handling beyond what is necessary to inspect the Product, Dione will assess the condition of the Product and apply the remedies permitted by applicable law.

Dione will not automatically reject a statutory withdrawal request solely because the Product has been handled.

However, the Customer remains responsible for any legally recoverable loss in value caused by handling beyond what is necessary to establish the Product’s nature, characteristics and proper functioning.

This policy is intended to protect the quality, hygiene and integrity of Dione Products while preserving the Customer’s mandatory statutory rights.

Article 8 – Statutory Legal Guarantees

Products sold by Dione benefit from the mandatory legal guarantees applicable under French law, including the legal guarantee of conformity and the legal guarantee against hidden defects, where the statutory conditions are met.

These legal guarantees apply independently of any commercial warranty that Dione may offer, if applicable.

The legal guarantees do not cover damage resulting from improper use, misuse, improper maintenance or treatment contrary to the care instructions provided by Dione, to the extent permitted by applicable law.

Nothing in these Terms limits the Customer’s mandatory statutory rights.

French consumer information requirements expressly include information about the existence and implementation of statutory guarantees, including the legal guarantee of conformity and the guarantee against hidden defects.

Article 9 – Retention of Title

Dione retains full ownership of the Products until full payment of the purchase price, shipping costs, taxes and any other applicable charges has been received.

This retention of title clause does not affect the transfer of risks in accordance with applicable law.

Article 10 – Liability

Dione uses reasonable efforts to maintain the availability and proper functioning of the Website.

Dione shall not be liable for interruptions, delays, technical failures or other disruptions resulting from circumstances beyond its reasonable control, including failures affecting internet networks, third-party technical providers, payment providers, logistics providers or other external service providers.

Dione shall not be liable for damage resulting from the Customer’s improper, abusive or non-compliant use of a Product, including use contrary to Dione’s care instructions or recommendations.

Dione shall not be responsible for consequences resulting from inaccurate, incomplete or outdated information provided by the Customer, including incorrect delivery details.

To the fullest extent permitted by applicable law, Dione’s liability shall be limited to direct, foreseeable and established losses resulting from a breach directly attributable to Dione.

Dione shall not be liable for indirect, incidental or consequential losses, including loss of use, loss of income, loss of opportunity or commercial loss, to the extent such limitation is permitted by applicable law.

Nothing in these Terms shall exclude or limit liability that cannot legally be excluded or limited.

Article 11 – Force Majeure

Dione shall not be liable for any delay or failure to perform its obligations resulting from an event of force majeure within the meaning of applicable law.

Such events may include, where the applicable legal conditions are met, events affecting transportation infrastructure, communication networks, suppliers, information systems, customs operations or supply chains.

Dione will inform the Customer within a reasonable period where such an event is likely to materially affect the performance of an order.

Where applicable law grants the Customer a right to cancel, obtain a refund or exercise another remedy following a prolonged force majeure event, such rights shall remain unaffected.

Article 12 – Personal Data and Privacy

Dione collects and processes certain personal data necessary for the operation of the Website and the performance of orders.

Personal data may be processed for the following purposes:

  • processing and tracking orders;
  • processing payments;
  • arranging deliveries;
  • managing returns and refunds;
  • responding to Customer Service requests;
  • preventing fraud;
  • accounting and compliance with legal obligations;
  • and sending marketing communications where the Customer has validly consented or where otherwise permitted by applicable law.

Dione limits the collection of personal data to information necessary for the purposes for which it is processed and processes such data in accordance with applicable data protection laws, including the General Data Protection Regulation (“GDPR”) where applicable.

Certain personal data may be shared with service providers necessary for the operation of the Website and fulfilment of orders, including payment providers, carriers, IT providers, hosting providers and technical service providers.

Where applicable, Customers may have rights including the right to access, rectify, erase, restrict or object to processing of their personal data, as well as the right to data portability.

Article 13 – Governing Law, Complaints and Disputes

These Terms and any sale concluded between Dione and the Customer shall be governed by French law, subject to any mandatory consumer protection provisions that may apply in the Customer’s country of residence.

In the event of a complaint or dispute, the Customer is encouraged to contact Dione first in order to seek an amicable resolution.

Where applicable, the Customer may also refer the matter to a competent consumer mediation service, in accordance with applicable French law and after first submitting a written complaint to Dione.

Nothing in these Terms limits or excludes any mandatory rights available to the Customer under applicable consumer protection laws.

Subject to mandatory jurisdictional rules applicable to consumers, any dispute relating to the interpretation, validity or performance of these Terms or to any sale concluded by Dione shall fall within the jurisdiction of the competent French courts.
